Hottest smartphones for Q4

The fourth quarter is here and the world's largest handset makers have spent the past several weeks unveiling the smartphones that they hope consumers will snap up during the holiday shopping season. Thus, it's worth taking a moment to make sense of what has been announced and to evaluate the key flagship phones that will be competing for the hearts (and wallets) of consumers.

After all, the holiday season is typically the most important selling season for smartphone manufacturers.

Nokia (NYSE:NOK) was the first to the party when on Sept. 5 it unveiled the Lumia 920 and 820, its first phones running Microsoft's (NASDAQ:MSFT) Windows Phone 8 software. Later that day Google's (NASDAQ:GOOG) Motorola Mobility unit announced three new phones in the Droid Razr line, bound exclusively for Verizon Wireless (NYSE:VZ) in the United States.

Then Apple (NASDAQ:AAPL) made headlines around the world a  week later on Sept. 12 when it announced the iPhone 5, a taller, thinner, faster version of the iPhone, and Apple's first LTE smartphone.

HTC joined the party in mid-September when it announced, in partnership with Microsoft, the high-end Windows Phone 8X and the mid-range Windows Phone 8S. In something of a swipe at Microsoft partner Nokia, HTC noted it would jointly promote the phones with Microsoft, and they would be "signature" Windows Phone 8 devices. That led to a bit of sniping from Chris Weber, Nokia's head of sales and marketing, who said that "while others may choose to tactically re-brand their products, Nokia is driving an industry-leading smartphone franchise--that we call Lumia--exclusively around Windows Phone."

The stage is now set. Microsoft and its hardware vendors will continue to push Windows Phone in the hopes that the platform will catch on with consumers. Meantime, Google and its Android partners hope to maintain their momentum in the market with increasingly powerful and innovative Android smarpthones. And everyone will be trying to blunt the energy of Apple, which sold five million iPhone 5s in its first weekend of availability, one million more units than it sold of the iPhone 4S in that device's first weekend of availability last year.

With that in mind, here is a quick primer on the hottest smartphones for the fourth quarter. A few caveats: This list is obviously not exhaustive, but it's a representative sample of the high-end smartphones that are either on the market right now or soon will be. Additionally, the list contains only smartphones that have either be announced for the U.S. market or likely will be sold by carriers in the U.S. by year-end. We have broken down the major pros and cons for each device, primarily based around their positioning in the market.

1. Report: Deutsche Telekom close to finalizing T-Mobile/MetroPCS deal

Deutsche Telekom is close to a deal to merge its T-Mobile USA operations with flat-rate player MetroPCS (NYSE:PCS), according to a Bloomberg report.

The report, which cited unnamed sources, said that Deutsche Telekom's board is scheduled to meet in Bonn tomorrow to approve the deal, which may be announced as soon as tomorrow. The report did not provide any other details on the proposed transaction. Reuters reported that a deal was close at hand, also citing unnamed sources. Representatives from DT, T-Mobile and MetroPCS did not immediately respond to a request for comment.

This is not the first time that DT and MetroPCS have been rumored to be part of a tie-up. A report last week from DealReporter indicated that MetroPCS was talking with T-Mobile , Dish Network and Sprint Nextel (NYSE:S) about possible mergers. In May, Bloomberg reported that DT was interested in merging T-Mobile with MetroPCS. That report said DT was considering a stock-swap transaction that would give it control over the combined entity, which would be publicly listed.

A merger between T-Mobile and MetroPCS would be complicated. Though they both use AWS spectrum, MetroPCS is a CDMA carrier while T-Mobile uses GSM technologies. MetroPCS has launched LTE service and has close to one million LTE subscribers. T-Mobile plans to deploy LTE on its 1700 MHz AWS spectrum next year.

Deutsche Telekom CEO Rene Obermann said earlier this year that it's unlikely DT will try to sell T-Mobile again after AT&T's (NYSE:T) $39 billion acquisition of T-Mobile fell apart in late 2011. However, he has left open the possibility of other kinds of partnerships to grow DT's U.S. business.

In an August  interview with FierceWireless, MetroPCS COO Tom Keys said that the time is ripe for some kind of industry consolidation. 

"It would probably be a better time to do it now than any other time you can think of in the recent past," he said. "Now, how, who, why, where and what--that's going to be up for debate. But at the end of the day, I think what you've seen with the AT&T/T-Mobile deal is that there's at least two companies that thought that consolidation was a good thing. So if you take that as a precursor, yes--[but] under the desire that we always a provide a good experience for the consumer and the consumer doesn't get harmed by having artificially higher rates because you have one less competitor." 

T-Mobile had 33.2 million customers at the end of the second quarter and MetroPCS had 9.3 million. T-Mobile has suffered recently from postpaid subscriber defections but is trying to turn that around by offering a new, unlimited smartphone plan and making its network more friendly to customers using Apple's (NASDAQ:AAPL) iPhone by refarming its 1900 MHz PCS spectrum to run HSPA+ service.

2. Dish's Ergen could confront FCC's Genachowski at PCIA show

ORLANDO, Fla.--Dish Network Chairman Charles Ergen and FCC Chairman Julius Genachowski will each give keynote speeches here tomorrow at the PCIA wireless infrastructure conference, and both are expected to sound familiar themes about their wireless priorities. 

That Ergen is speaking at a wireless infrastructure conference is an indication of how deeply involved in the mobile market Dish has become during the past year. Ergen's company paid $2.78 billion in 2011 for its 40 MHz of S-band satellite spectrum, and Dish is awaiting an FCC ruling on the terrestrial use of that spectrum before it makes more concrete wireless plans. Dish has said it plans to deploy an LTE Advanced network on the spectrum by 2016, but needs a waiver from the FCC to sell terrestrial-only devices for its business plan to work.

Some have speculated that Ergen will announce a partnership with another wireless carrier at the show. While a possibility, an announcement like that is unlikely to occur before the FCC finalizes its rules for the spectrum, officially known as the "AWS-4" band. Ergen is likely to press the FCC to finish up the rulemaking, grant it the waiver and not change Dish's spectrum positioning. The company has been arguing for months that the FCC should not shift part of its holdings by 5 MHz. 

Dish inked a deal in June with Qualcomm (NASDAQ:QCOM) and Ergen said in August the company did so because Dish needed to ensure chipsets and handsets could be made that work with its spectrum regardless of the FCC proceeding.

It's unclear if Genachowski will touch on the Dish proceeding in his remarks. However, he is likely to discuss the need to get spectrum into the market more broadly, a key piece of his agenda since becoming chairman. The FCC voted last week to begin setting rules that will govern voluntary incentive auctions of broadcast TV spectrum for mobile broadband use. One avenue of his discussion could be the impact those auctions will have on the infrastructure industry, especially as broadcasters' spectrum holdings are shifted as part of the auction process.

Genachowski is also likely to touch on how the FCC has helped the infrastructure industry and continues to do so. In November 2009 the FCC ruled to give states and localities a so-called "shot clock" for tower siting applications. The rules state there is a deadline of 90 days to process applications for co-located facilities, where two or more providers share the tower, and 150 days for new towers.

3. Rumor Mill: Apple's 'iPad mini' event to be held Oct. 17

Apple (NASDAQ:AAPL) may send out invitations on Oct. 10 for an Oct. 17 unveiling of a smaller iPad tablet, according to a Fortune report.

The rumor mill around the so-called "iPad mini" keeps on churning, with Fortune reporting that an unnamed "major Apple investor" has heard from "multiple sources" that such an event is scheduled for later this month. The Oct. 10 invitation date seems to augur with an Oct. 17 unveiling, given Apple's event schedule history, the report noted.

An Apple spokeswoman did not immediately respond to a request for comment.

In August AllThingsD reported that Apple would announce an iPad with an 8-inch screen or smaller in October. That follows reports in July from Bloomberg and the Wall Street Journal that Apple was in the final stages of preparing for the launch of a smaller iPad, which the reports said would likely have a 7-inch screen. The iPad's screen has been 9.7-inches diagonally since it was introduced in 2010.

Former Apple CEO Steve Jobs was "very receptive" to the idea of a 7-inch iPad by early 2011, according to evidence submitted during the patent-infringement trial between Apple and Samsung Electronics. Apple executive Eddy Cue, now the company's senior vice president of Internet software and services, said in a January 2011 email to top executives that he had spoken with Jobs in recent months about the idea and that Jobs "seemed very receptive the last time." The disclosure was notable because in October 2010 Jobs lambasted the idea of a 7-inch tablet.

A smaller iPad would compete more directly with Google's (NASDAQ:GOOG) Nexus 7 and Amazon's Kindle Fire HD line. According to a recent report from the Pew Research Center, 52 percent of tablet owners reported having an iPad, down from 81 percent in Pew's 2011 survey. Android-based devices made up the remainder of the U.S. tablet market, the Pew survey found.

According to research firm IDC, the Kindle Fire represented just 5 percent of the global tablet market in the second quarter, compared with 68 percent for the iPad and 9.6 percent for Samsung Electronics' tablets. Apple has sold 67 million iPads since the device went on sale, including 11.8 million in its most recent quarter. The newest iPad has LTE capabilities and is offered by Verizon Wireless (NYSE:VZ) and AT&T Mobility (NYSE:T) in the United States.

4. Samsung sues Apple over iPhone 5 patent infringements

Samsung Electronics is suing Apple (NASDAQ:AAPL) for patent infringement in its new iPhone 5 smartphone. Samsung is accusing Apple of violating eight of its patents.

Samsung filed suit against Apple in U.S. District Court in San Jose, Calif., as part of an existing lawsuit between the two companies. In a separate case held in that court, a jury found in August that Samsung had violated six of seven Apple patents and was liable for $1.05 billion in damages.

"As soon as the iPhone 5 was available for purchase, Samsung began its investigation of the product," the company said in its court filing. Samsung said the iPhone 5 infringes on two standards patents and six features patents. Apple declined to comment, according to Bloomberg. This patent case could go to trial in 2014.

The previous trial, in which Apple was awarded $1.05 billion in damages, was considered a proxy battle between Apple and Google (NASDAQ:GOOG) since Samsung is the world's largest handset maker using Google's Android platform.

Separately, U.S. District Court Judge Lucy Koh, who presided over the earlier trial between the two companies, lifted a U.S. sales ban on Samsung's GalaxyTab 10.1 tablet. Koh had put in place an injunction against the tablet before the trial, but the jury found that the tablet did not violate the Apple design patent that was the basis for the injunction. Apple said the ban should remain in place because the tablet violates its other patents.

5. NTIA seeks comment on design of public-safety broadband network

The National Telecommunications and Information Administration (NTIA) is seeking comment on the design and business plan of the nation's proposed interoperable public-safety broadband network.

The NTIA said that the First Responder Network Authority (FirstNet), the body inside the NTIA in charge of designing the network, wants comment on the "conceptual network architecture" for the network as well as several other areas. NTIA is also seeking input on the general concept of how to develop applications for public-safety users. The request for comments comes after FirstNet's board held its first meeting on Sept. 25. Comments are due Nov. 1.

At its inaugural meeting, FirstNet got up and running and took several actions. The group adopted bylaws, set up a State, Regional, Local, and Tribal Consultation Committee, and requested the FCC transfer the public-safety spectrum license to FirstNet. The agency hopes to leverage existing resources and infrastructure as much as possible to achieve the major elements of the nationwide wireless network.

Other issues the board must deal with include how to partner with commercial carriers and use existing commercial infrastructure to reduce the buildout costs of the network; how the network will be maintained and upgraded as LTE technologies evolve; how roaming agreements with commercial carriers will be structured; how public-safety workers will get priority access to the network in cases of emergencies; and how devices for the network will be certified.
