5 reasons why Amazon may never release a smartphone

According to a new report from DigiTimes, Amazon (NASDAQ:AMZN) plans to release a 4.7-inch smartphone in the second quarter of this year. The company was considering a 4.3-inch screen phone, according to the report, but decided to go with a bigger one due to increasing consumer demand for giant phones.

Although DigiTimes has a mixed track record in the rumor department, the publication is by no means the first to tip the imminent release of an Amazon smartphone. A New York Times post in 2010 indicated Amazon was considering a smartphone. Topeka Capital Markets analyst Brian White wrote last year that Amazon would release a smartphone by the end of 2012, a rumor bolstered by a Bloomberg report in July 2012 of an impending Amazon smartphone. And The Verge "confirmed" the Amazon smartphone in a Sept. 5, 2012, article, and noted the gadget "could be announced tomorrow."

Now, to be clear, an Amazon smartphone could well be announced tomorrow. I really don't know. I have no insider insight into the company. But what I do know is that Amazon has very little chance of being successful in the smartphone market, if it does decide to enter the business. Here are five reasons Amazon would do well to let the rumors of an Amazon smartphone remain just that:

1. The smartphone market is not easy.

"It's a bad business that's very difficult to succeed in," noted Jonathan Chaplin of New Street Research. "It's a business that requires massive amounts of capital and R&D."

It's a well-documented fact that Samsung Electronics and Apple (NASDAQ:AAPL) are the only two really profitable smartphone makers in the world. Dozens of other smartphone makers, including top-tier ones--think LG Electronics, HTC, Nokia (NYSE:NOK), BlackBerry (NASDAQ:BBRY) and Sony Mobile Communications--are either struggling or just drawing even. Even Chinese manufacturers, which would presumably benefit from lower production costs, are reporting sluggish handset sales.

It's not impossible to break into the smartphone market and become successful--Apple managed to do just that starting in 2007--but the odds are not good (just ask Hewlett-Packard, Dell, Sendo, Sierra Wireless… the list goes on)...Continued

1. Sprint won't use Huawei gear, says lawmaker

Sprint Nextel (NYSE:S) and Japanese suitor Softbank told lawmakers they will not use gear from Chinese vendor Huawei in Sprint's network, according to a senior U.S. lawmaker involved in intelligence activities.

The comments from the lawmaker, Rep. Mike Rogers (R-Mich.), came after the Wall Street Journal reported that the U.S. government wants to be able to review Sprint's network equipment purchases as a condition of Softbank's proposed $20.1 billion purchase of 70 percent of Sprint. The action is likely an attempt by the government to block Sprint from buying equipment from  Huawei and fellow Chinese vendor ZTE. Rogers is the chairman of the House Permanent Select Committee on Intelligence.

"I have met with Softbank and Sprint regarding this merger and was assured they would not integrate Huawei in to the Sprint network and would take mitigation efforts to replace Huawei equipment in the Clearwire network," Rogers said in a statement. "I expect them to make the same assurances before any approval of the deal in the CFIUS process." CIFUS refers to the Committee on Foreign Investment in the United States, a group led by the Treasury Department, which must approve the deal.

Sprint declined to comment.

Rogers said Sprint and Softbank also agreed to eventually replace the Huawei equipment used by Clearwire (NASDAQ:CLWR), which Sprint wants to purchase. Clearwire has said that Huawei's gear is deployed at the edge of Clearwire's network, while its core network equipment is being provided by domestic vendors Cisco and Ciena. Clearwire picked Huawei as one of its RAN vendors after getting approval from the U.S. government.

The Journal reported that, according to unnamed sources familiar with the matter, there has been no serious discussions of requiring Clearwire to decommission its existing Huawei equipment.

A government report last year found that Huawei and ZTE pose a security risk because their network equipment could be used for espionage. The report, from the House intelligence committee, recommended the U.S. block acquisitions and mergers involving the two firms and also recommends that the U.S. government and U.S. companies avoid using equipment from the two Chinese companies. Huawei and ZTE vigorously denied the charges, which they said were unfounded and motivated by politics. They said they are not connected to the Chinese government or military and that operators around the world, including those in Western Europe, use their network gear.

"If government approval of the transaction is somehow contingent on an agreement to restrict purchase of equipment from any vendor based on the flag of heritage, then it is a sad day for free and open global trade and it does nothing to secure the network," Huawei spokesman William Plummer told Bloomberg. "Everyone is global and every company faces the same cyber challenges."

2. T-Mobile confirms job cuts at HQ ahead of MetroPCS merger

T-Mobile USA confirmed job cuts at its headquarters in Bellevue, Wash., after weeks of refusing to acknowledge the cuts, but the carrier did not specify how many jobs have been culled.

According to the Seattle Times, which first reported on the cuts last month, T-Mobile axed between 200 and 300 employees in its operations group, ranging from administrative assistants to senior vice presidents. The report, without citing sources, said those cutes were in addition to the roughly 100 people cut from the company's marketing department recently.

The cuts come just days ahead of an April 12 vote by MetroPCS (NYSE:PCS) shareholders on the proposed merger with T-Mobile, and shortly after T-Mobile formally unveiled its new no-contract pricing, LTE network and plans to launch the iPhone. 

T-Mobile and MetroPCS hope to achieve $6 billion to $7 billion in post-deal "synergies." T-Mobile plans to maintain MetroPCS' brand and retail locations while merging the two companies' networks and migrating MetroPCS' customers off of CDMA and onto LTE.

"As you know, T Mobile announced a series of moves Tuesday that are part of our new business strategy designed to address consumer frustration with the unnecessary cost and complexity of wireless," the company said in a statement. "As a result, we are making some operational changes to better align our business with our new strategy and position T-Mobile for growth. This affects a small number of employees relative to the overall size of the business, and while we don't take these actions lightly, these adjustments to how we invest in the business will enable us to better focus our resources as we implement this strategy. Customer service at every level remains our highest priority."

Last year as part of reorganization T-Mobile cut a net 350 jobs. The carrier slashed 900 positions across the company but also pledged to add 550 additional jobs "to support the needs of the business and strategic opportunities." T-Mobile has also been busy expanding its B2B unit, which it said last year would lead to around 1,000 more jobs in the coming years. T-Mobile also announced a net loss of 1,900 jobs in March 2012 to consolidate the number of its call centers around the country from 24 down to 17. Last year the company had about 4,800 employees at its Bellevue headquarters and 36,000 nationally.

3. Samsung confirms that Apple could get more than $1.05B in new patent trial

Samsung Electronics confirmed in a court filing late Friday that Apple (NASDAQ:AAPL) could potentially wind up receiving more in damages in a new patent-infringement trial than the $1.05 billion it was originally awarded last August.

"Apple can seek even more damages on these products in the new trial," Samsung acknowledged in a filing, first spotted by Florian Mueller of the Foss Patents blog. Mueller pointed out that this possibility actually came to light roughly a month ago when the judge who oversaw the $1.05 billion blockbuster patent infringement case between Apple and Samsung slashed the damages in the case by $450.5 million and ordered a new trial.

In theory, a new jury in a new trial could give Apple more damages than the $1.05 billion it originally won, less or an identical amount. Mueller wrote that there was always a possibility that Apple could get more in damages, but that this fact was not noted by many.

"The focus of most reports and comments has been on what Apple presumably 'lost,'" he wrote. "Samsung certainly wanted to vacate as large a portion of the damages award as possible, and getting $450 million vacated is no small achievement--but it would be foolish to think (or at least ignorant of the damages claim Apple was actually allowed to present last year) that the only way is down at this stage."

U.S. District Judge Lucy Koh reduced the jury's damage award by 43 percent, bringing it down to $598.9 million. To reduce the damages Koh removed certain devices from the order. In addition, Koh ordered a new trial to decide how much Apple should be paid for the devices that she cut from the damages.

In reviewing the jury's decision in the case decided last August, Koh found that the jury made an acceptable ruling in deciding that Samsung had infringed on Apple's patents. However, she wrote that the jury made two key errors in deciding the damages. Koh wrote that the jury erred in using Samsung's profits to decide how much money Samsung owed Apple for infringing on Apple's utility patents; she said profits should only be used when evaluating design patents. Koh also wrote that the jury was incorrect in deciding the time period Apple should be awarded damages for.

4. FCC launches inquiry into cell phone radiation effects

Nine months after FCC Chairman Julius Genachowski said the FCC might launch an inquiry into whether its cell phone radiation emission standards need to be changed--amid concerns that mobile phone radiation may cause brain cancer--the commission actually opened the inquiry.

The FCC formally opened a notice of inquiry into the issue, but also said that at this point it is comfortable with the current limits on RF radiation exposure. "We continue to have confidence in the current exposure limits, and note that more recent international standards have a similar basis," the FCC's initial report said. Additionally, the FCC report now defines the outer ear as an "extremity," meaning it can absorb considerably more radiation without breaching FCC guidelines.

Now that the FCC's notice of inquiry is official, the public has 90 days to comment on it. The FCC's guidelines, which have not been updated since 1996, set a maximum limit on radiation exposure levels based on how much heat is emitted and absorbed by cell phones.

The FCC's report came in response to a report last summer from the Government Accountability Office, which urged the FCC to revise its 16-year-old cell phone radiation standards. In a 46-page report, the GAO, which is the investigative arm of Congress, noted that the FCC has laid out its cell phone radiation limits based on the recommendations of federal and international health organizations, but that many of these bodies have since updated their standards based new research.

The CTIA has long maintained that cell phone radiation does not cause cancer or other adverse health effects. Studies on the issue have been inconclusive, and the National Cancer Institute, which is part of the National Institutes of Health, has said there is no consistent evidence that radiation from cell phones increases the likelihood of cancer.

"As the GAO stated in its July 2012 report, 'Scientific research to date has not demonstrated adverse human health effects of exposure to radio-frequency energy from mobile phone use, but research is ongoing that may increase understanding of any possible effects,'" John Walls, vice president of public affairs at CTIA, said in a statement. "The U.S. Food and Drug Administration and the National Institutes of Health have reached similar conclusions about the state of the science. As this review proceeds, it is important to recall the FCC's Director of Communications has said, 'We are confident that, as set, the [FCC's] emissions guidelines for devices pose no harm to consumers.'"

In May 2011, the World Health Organization said electromagnetic radiation from mobile phones is "possibly carcinogenic to humans, based on an increased risk for glioma, a malignant type of brain cancer, associated with wireless phone use."

5. Broadway concerned about losing 600 MHz TV white space spectrum

Broadway theaters are growing increasingly concerned about the impact the FCC's planned 600 MHz spectrum auctions will have on wireless microphones used in live performances.

The FCC's planned incentive auction, in which it hopes to persuade broadcast stations to free up some of their 600 MHz spectrum, is aimed at opening up frequencies for licensed mobile broadband services as well as unlicensed operations in TV white space (TVWS), the unoccupied spectrum that sits between TV channels. However, wireless mics and other devices already operate in TVWS.

Wireless microphones and other low power auxiliary devices are currently allowed to operate on unused channels in the UHF and VHF frequency bands used by broadcast television (TV channels 2-51, except channel 37) on both a licensed and an unlicensed basis. The FCC has proposed opening wireless broadband uplink band at channel 51 and expanding downward toward channel 37, with a downlink beginning at channel 36 and expanding downward.

According to the New York Times, the Broadway League, a national trade association, has told the FCC that interference with wireless mics could devastate the sound and stagecraft at major productions. Aside from disrupting performances, such interference might result in physical harm to actors and production workers and ultimately cause significant financial damage to the performance industry.

The Broadway League takes particular issue with a proposed requirement that users of wireless mics register in a database for channel protection, starting a thirty-day notice and comment procedure. The group contends such a scenario is unworkable in numerous instances. For example, touring companies bringing a Broadway musical production to different cities must set up in a matter of days, making adjustments to coordinate with local TV broadcasters and other known users in the vicinity of the theatre.

"There may well be frequencies that are unusable because of regular or sporadic use by unidentified parties. Only after this on-site coordination will a touring-company know whether it will need to register in the database for protection on additional channels. There simply is no opportunity for a thirty-day notice and comment procedure," said the association in comments filed in January.  

The Broadway League has proposed that the FCC provide spectrum licensed under Part 74 rules to professional theatrical productions, ensuring they can register directly with one of the TV bands database administrators for protection from interference from unlicensed operations by TV white space devices. Part 74 licenses are currently limited to AM, FM, TV stations, broadcast networks and cable television systems operators, motion picture and television program producers and certain Broadband Radio Service and Educational Broadcast service stations.

This is not the first time theaters and companies have been faced with shifting their wireless mic operations, as they had to acquire new equipment when the FCC opened up the 700 MHz band (frequencies between 698 and 806 MHz, also known as TV channels 52-69). At that time, the FCC reserved two channels for wireless mics near TV channel 37 for wireless mic use. However, those channels are wide enough to accommodate only 15 to 20 wireless mics, or fewer than one-third needed for the Broadway stage production of Mamma Mia!

"The more the FCC auctions off, the smaller our part gets," Tom Ferrugia, director of government relations for the Broadway League, told the New York Times.

The 120 MHz the FCC hopes to get from the 600 MHz incentive auctions is a major piece of the 300 MHz the agency aims to free for mobile broadband by 2015. Broadcaster participation, however, is voluntary, meaning the FCC may garner considerably less than 120 MHz of 600 MHz spectrum for wireless broadband use.

SPOTLIGHT ON... Report: AT&T could bundle Aereo's TV service with wireless data

Aereo, which streams local TV broadcast signals online to smartphones, tablets and other IP-connected devices for a fee, could strike a partnership with AT&T Mobility (NYSE:T), according to a Wall Street Journal report. The report, citing unnamed sources, said Aereo has had talks with AT&T and Dish Network (NASDAQ: DISH). Under one idea that was discussed, AT&T would sell broadband or wireless data subscriptions paired with Aereo's video service, the report said. Aereo declined to comment on any specific talks. In January the company announced a plan to reach 22 markets in 2013, including Atlanta, Chicago, Philadelphia and Washington, D.C.
