The Holiday Crush Sweepstakes (the "Sweepstakes") is open only to legal residents of the fifty United States and the District of Columbia and Canada, excluding Quebec, who are at least eighteen (18) years of age as of the date of entry. VOID IN QUEBEC AND WHERE PROHIBITED BY LAW. Officers, directors, employees, agents and representatives of Coldwater Creek Inc., any parent, affiliated and related companies, advertising and promotional agencies, suppliers of materials and services related to this Sweepstakes, and members of their immediate families (defined as parents, siblings, children and spouses, regardless of where they live) or household members (whether related or not) are not eligible. Participation constitutes entrant's agreement to these Official Rules. Winning a prize is contingent upon fulfilling all requirements set forth herein.

- TIMING. The Sweepstakes Period begins on October 31, 2011 at 5:00:01 p.m., Pacific Time and ends on November 21, 2011 at 11:59:59 p.m., Pacific Time (the "Sweepstakes Period"). Coldwater Creek's computer is the official time-keeping device for this Sweepstakes.
- HOW TO ENTER. NO PURCHASE NECESSARY. Internet access required. Enter the Sweepstakes by "liking" Coldwater Creek's page on facebook.com, after which the entrant will receive a link to an entry form to fill out and submit.
THIS PROMOTION IS IN NO WAY SPONSORED, ENDORSED OR ADMINISTERED BY, OR ASSOCIATED WITH, FACEBOOK. YOU UNDERSTAND THAT YOU ARE PROVIDING YOUR INFORMATION TO COLDWATER CREEK AND NOT TO FACEBOOK. THE INFORMATION YOU PROVIDE WILL ONLY BE USED BY COLDWATER CREEK FOR ADMINISTERING THIS SWEEPSTAKES, FULFILLING PRIZES, OR AS YOU OTHERWISE.
LIMIT OF ONE (1) ENTRY PER PERSON PER WEEK DURING THE SWEEPSTAKES PERIOD. If it is discovered that you have entered or attempted to enter the Sweepstakes more than once or have attempted to enter multiple times using multiple identities, only the first entry will be recognized and any later entries will be declared null and void, and any prize you might have been entitled to from any entry other than the first entry will not be awarded. AN ENTRY MUST BE RECEIVED DURING THE SWEEPSTAKES PERIOD TO BE ELIGIBLE. No other means of transmission or delivery will be accepted. Late, garbled, incomplete or misdirected entries will be declared void and will be ineligible to win. The sole determinant of time for the purposes of receipt of a valid entry in this Sweepstakes will be the Sweepstakes server machine(s). Proof of submission (screen captures, etc.) does not constitute proof of entry. All entries become property of Coldwater Creek and will not be returned.
- PRIZE - WEEKLY DRAWING. At approximately 5:00:01 PM Pacific Time on each Monday of the Sweepstakes Period, Coldwater Creek will randomly draw one (1) entry from among all eligible entries previously received from the entry method. The odds of winning depend on the total number of eligible entries received prior to such weekly drawing. Each week during the Sweepstakes Period, an entrant will be chosen to win a member of the Style Squad's favorite articles of clothing (also known as the "Holiday Crushes"). During the first week, Bailey's Holiday Crushes will be the prize. During the second week, Sabrina's Holiday Crushes will be the prize. During the third week, Sheryl's Holiday Crushes will be the prize. There are three (3) prizes available to be won. All decisions by Coldwater Creek are final and binding. No person may win more than one (1) prize. Non-winning entrants may enter again after each week's weekly drawing.
The prize must be accepted as awarded and is non-transferable and no substitution (whether in cash or otherwise) will be made except that Coldwater Creek reserves the right to substitute a prize of equal or greater monetary value, in cash or otherwise, at its sole discretion, if a prize, or any component of any prize, cannot be awarded for any reason. Sponsor will not replace any lost or stolen prizes. The winner is responsible for all taxes and fees associated with prize receipt and/or use not expressly stated herein.
- VERIFICATION OF WINNER. The potential winner must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. The potential winner of each week's prize will be notified by phone or email within approximately five (5) days after the close of each weekly Sweepstakes Period at the email address provided by entrant at the time of entry. Please check your email and spam filters. Before being declared the official winner, the potential winner may be required to execute and return to Coldwater Creek (or its authorized agent) a declaration or affidavit of eligibility/liability and publicity release and, for U.S. residents, a W-9 form no later than ten (10) business days after the time such forms are postmarked as having been sent by Coldwater Creek. If the winner cannot be contacted, or fails to sign and return the forms within the required time period, or if the prize notification is returned as undeliverable, the potential winner will be deemed to have forfeited her prize. If potential winner is 18 years of age or older, but is not of the age of majority in his or her state, province or territory of residency, the prize will be awarded in the name of his or her parent or legal guardian, who will be required to also complete the necessary declaration and/or affidavit.
For Residents of Canada Only: In order to be declared the official winner, the potential winner will also be required to correctly answer without assistance of any kind, whether mechanical or otherwise, a time-limited mathematical skill-testing question to be administered at a mutually convenient time by telephone. In the event that a potential winner is disqualified for any reason, Coldwater Creek may, at it sole discretion, select an alternate potential winner to award the prize, based on the winner selection criteria described above, from among all remaining eligible entrants who will be subject to disqualification in the same manner.
- CONDITIONS OF ENTRY.
- By entering, you (i) acknowledge you are in compliance with these Official Rules including all eligibility requirements, and (ii) agree to be bound by the decision of Coldwater Creek which shall be final and binding in all matters relating to this Sweepstakes. Entrants who have not complied with these Official Rules are subject to disqualification and all associated entries will be void.
- Coldwater Creek reserves the right to disqualify any entrant's registration in the Sweepstakes (and void all associated entries) or entitlement to a prize, if, in the sole discretion of Coldwater Creek, it determines or suspects that the entrant has attempted to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, or other fraudulent, deceptive or unfair playing practices (including any entries generated by script, macro, robotic, programmed, or any other automated means or any other means which subvert the entry process).
- If a dispute arises regarding who submitted an online entry, the entry will be deemed to be submitted by the authorized account holder of the email address provided at the time of entry and he/she must comply with these Official Rules. "Authorized account holder" is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address. The potential winner may be required to show proof of being the authorized account holder.
- Coldwater Creek reserves the right in its sole discretion to cancel, modify or suspend this Sweepstakes at any time with or without notice if fraud, technical failures (including any network server or hardware failure), viruses, bugs, errors in programming, or any other causes corrupt the administration, security or integrity of the Sweepstakes. In the event of cancellation, Coldwater Creek reserves the right to select Winners from among all eligible, non-suspect entries received up to the time of such cancellation.
- Neither Coldwater Creek nor Facebook warrant that access to the Sweepstakes will be uninterrupted. Neither Coldwater Creek nor Facebook are responsible for, and you hereby waive any claim arising from, any problems that may arise, including, without limitation: (i) inaccessible or unavailable networks, websites, or other connection or accessibility problems; (ii) failed, delayed or misdirected communications, including any lost, late, stolen, incomplete, illegible or undelivered entries; (iii) technical malfunctions, printing, clerical, or other errors in connection with the administration of the Sweepstakes or the offering or announcement of any prize; (iv) the incorrect or inaccurate capture of information, or the failure to capture any information in connection with the Sweepstakes; (v) damage to a user's system occasioned by participation in this Sweepstakes; or (vi) any other errors of any kind relating to or in connection with the Sweepstakes.
- PRIVACY: Personal information collected from entrants will be used by Coldwater Creek and its authorized agents to administer this Sweepstakes and to award the prize, unless you otherwise consent to receive emails or to use of your information for other promotional purposes. By accepting a prize, winner consents to Coldwater Creek's use of his/her name, city/state/province of residence, picture, biographical information, statements, voice and likeness and images, in any advertising, promotion and publicity in any manner, format and in any medium now known or hereafter devised, including but not limited to the world wide web, throughout the world at any time or times in perpetuity. - LIMITATION OF LIABILITY AND RELEASES: As a condition of entering, you agree: (i) to release Coldwater Creek from any and all liability, injury, loss or damage of any kind to persons or property incurred with respect to participating in the Sweepstakes or the awarding, receipt, possession, and/or use or misuse of any prize or any travel or activity related thereto; (ii) that under no circumstances will you be permitted to obtain awards for, and you hereby waive all rights to claim, punitive, incidental or consequential damages from Coldwater Creek; (iii) all causes of action arising out of or connected with this Sweepstakes or the prize awarded shall be resolved individually, without resort to any form of class action; and (iv) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, and in no event will you be entitled to receive attorneys' fees or court costs. Coldwater Creek is not responsible for, and you hereby waive any claim arising from, any problems that may arise, including, without limitation: (i) inaccessible or unavailable networks, websites, or other connection or accessibility problems, including telephone networks or lines, computers or computer on-line systems, servers or providers, computer equipment, software, viruses or bugs; (ii) failed, delayed or misdirected communications, including any lost, late, stolen, incomplete, illegible or undelivered Entries; (iii) technical malfunctions, printing or other errors in connection with the administration of the Sweepstakes or the offering or announcement of any prize, including printing, distribution, programming or production errors, and any other errors or malfunctions of any kind, whether human, mechanical, electronic or otherwise; (iv) damage to a user's system occasioned by participation in this Sweepstakes; (v) any other errors of any kind relating to or in connection with the Sweepstakes, whether caused by Sweepstakes Email users, or by any of the equipment or programming associated with or utilized in the Sweepstakes, or by any technical or human error which may occur in the processing of submissions in the Sweepstakes; (vi) the theft, destruction, loss or unauthorized access to, or alteration of, entries; (vii) garbled transmissions or miscommunications; (viii) failure of any e-mail to be received by or from any Sweepstakes judging organization or Coldwater Creek for any reason, including but not limited to traffic congestion on the Internet or at any website or combination thereof or technical incompatibility; (ix) technical, pictorial, typographical or editorial errors or omissions contained herein.
- MISCELLANEOUS.
- Any attempt by an entrant or other individual to deliberately damage any website or undermine the legitimate operation of this Sweepstakes, including but not limited to any fraudulent claims, is a violation of criminal and civil laws. Coldwater Creek reserves the right to seek remedies and damages (including attorneys' fees) from any such individual, to the fullest extent permitted by law, including criminal prosecution. Any entrant engaging in any of the foregoing activities may be disqualified (and the associated entry will be void) and will forfeit any prize won.
- Coldwater Creek reserves the right in its sole discretion to cancel, modify or suspend this Sweepstakes, in whole or in part, at any time with or without notice or obligation if, in Coldwater Creek's sole discretion, any factors interfere with its proper conduct as contemplated by these Official Rules. Without limiting the generality of the foregoing, if the Sweepstakes, or any part thereof, is not capable of running as planned for any reason, including but not limited to fraud, technical failures (including any network server or hardware failure), viruses, bugs, errors in programming, tampering, unauthorized intervention or any other causes that, in the sole opinion of Coldwater Creek, corrupt the administration, security, fairness or integrity or proper conduct of the Sweepstakes, Coldwater Creek may, in its sole discretion, void any suspect Entries and: (a) terminate the Sweepstakes, or any portion thereof; (b) modify or suspend the Sweepstakes, or any portion thereof, to address the impairment and then resume the Sweepstakes, or relevant portion, in a manner that best conforms to the spirit of these Official Rules; and/or (c) award the prize from among the eligible, non-suspect Entries received up to the time of the impairment in accordance with the Terms of Submission discussed above and these Official Rules.
- All entries become Coldwater Creek's property and will not be returned or acknowledged. Mass entries, automated entries, entries submitted by third parties, and any entries or prize claims that are late, incomplete, fraudulent, illegible, unidentified or delayed will be void. All entries and prize claims are subject to verification. Coldwater Creek reserves the right to correct any typographical, printing, computer programming or operator errors. Coldwater Creek's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Should a winner make any false statement(s) in any document referenced herein, the winner will be required to promptly return to Coldwater Creek his/her prize, or the cash value thereof. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. If any provision of the Official Rules is determined to be invalid or otherwise unenforceable, then the Official Rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein. This Sweepstakes is subject to all applicable federal, state provincial, territorial and municipal laws. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Coldwater Creek in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the substantive laws of the State of Idaho without regard to conflicts of law principles. All entrants consent to the jurisdiction and venue of the Federal, state and local courts of Idaho.
- In the event of any conflict with any Sweepstakes details contained in these Official Rules and Sweepstakes details contained in other materials (including, without limitation, any point of sale, online or print advertising), the details of the Sweepstakes as set forth in these Official Rules shall prevail.
