U.S. Supreme Court: Warrant Required for GPS Tracking

The U.S. Supreme Court has issued a unanimous ruling saying that police need a warrant if they want to track a suspect's car using GPS.


The court made its decision in a case involving Washington, D.C. Club nightclub owner Antoine Jones. Police had attached a tracking device to his Jeep, leading them to a suburban home in which drugs and money were found. Jones was sentenced to life in prison, but the conviction was overturned by an appeals court.


All of the Supreme Court justices agreed that attaching the device to the car violated the Fourth Amendment provisions against unreasonable search and seizure.


“By attaching the device to the Jeep," Associate Justice Antonin Scalia said in the Supreme Court's main decision, "officers encroached on a protected area."
