Analyst: A Sprint/MetroPCS merger more likely than one with T-Mobile A deal between Sprint Nextel (NYSE:S) and flat-rate player MetroPCS (NYSE:PCS) makes much more sense than one between Sprint and No. 4 carrier T-Mobile USA, according to a Goldman Sachs analyst. In a research report, Goldman Sachs analyst Jason Armstrong noted that Sprint's rising stock price has increased speculation that the carrier will engage in some kind of M&A activity. He said a deal for a smaller, regional carrier would be much easier to pull off than a deal with T-Mobile, which he called "aspirational" rather than likely. He wrote Cricket provider Leap Wireless (NASDAQ:LEAP) could also be a potential Sprint target. A Sprint merger with MetroPCS or Leap would be less technically complicated than one with T-Mobile, since T-Mobile's network is based on GSM and HSPA+ technology and MetroPCS and Leap are CDMA carriers like Sprint. Still, the smaller carriers' AWS spectrum would need to be rationalized with Sprint's network. A deal for MetroPCS was reportedly close to being finalized earlier this year but was killed by Sprint's board; Sprint has never confirmed or discussed any of the reports about the MetroPCS deal. "A smaller prepaid-centric deal may be the more logical route for now if Sprint determines to pursue M&A," Armstrong wrote. Sprint declined to comment, according to Bloomberg. Sprint's stock has climbed 114 percent in 2012 and was trading at slightly over $5 per share this morning. The carrier has produced stronger subscriber results in recent quarters. Sprint has left the door open for consolidation. "We're certainly working very hard to compete with AT&T and Verizon," Sprint CEO Dan Hesse said in August. "The industry has to deal with the issue of the duopoly. The gap between the No. 2 and No. 3 players is enormous. We always have been and always will be open to further consolidation, as long as it isn't AT&T or Verizon Wireless." In a recent interview with FierceWireless, MetroPCS COO Tom Keys said that the time is ripe for some kind of industry consolidation. "It would probably be a better time to do it now than any other time you can think of in the recent past," he said. "Now, how, who, why, where and what--that's going to be up for debate. But at the end of the day, I think what you've seen with the AT&T/T-Mobile deal is that there's at least two companies that thought that consolidation was a good thing. So if you take that as a precursor, yes--[but] under the desire that we always a provide a good experience for the consumer and the consumer doesn't get harmed by having artificially higher rates because you have one less competitor." Clearwire CFO: WiMAX network to generate more revenue than expected Clearwire's (NASDAQ:CLWR) WiMAX network may make money for the company longer than initially expected. Hope Cochran, Clearwire's CFO, said that the company is signing up wholesale customers for the WiMAX network, giving the WiMAX network a longer lifespan and more revenue than previously expected. Speaking today at the Bank of America Merrill Lynch 2012 Media, Communication and Entertainment conference, Cochran said that while these wholesale customers plan to transition to LTE, they will provide the WiMAX network with a "longer revenue tail than I anticipated." Cochran noted that partner Sprint Nextel (NYSE:S), which is Clearwire's largest wholesale customer, plans to transition to a usage-based model for the WiMAX network in 2014, and that having these additional wholesale partners will help with that transition. Just last week Clearwire signed a wholesale deal with EarthLink that will allow EarthLink to launch consumer-facing mobile WiMAX and LTE services in 2013. In addition, Clearwire has WiMAX wholesale deals with FreedomPop, Jolt Mobile, H2O Wireless and Voyager Mobile. Earlier this this year Clearwire signed a wholesale deal with Cricket provider Leap Wireless (NASDAQ:LEAP). However, Cricket plans to only use Clearwire's TD-LTE network when it launches in 2013. In late December, Sprint and Clearwire agreed to shift to a usage-based pricing model for WiMAX services in 2014. However Sprint will continue to have access to Clearwire's WiMAX network through at least 2015. Interestingly, Cochran was asked about whether Clearwire is working with Dish Network, which in 2011 paid $2.78 billion for S-band MSS spectrum. Dish has said it plans to use the spectrum to build an LTE Advanced network by 2016. Cochran said that everyone in the industry is curious about what Dish might do but declined to say whether Clearwire is directly working with the company. "We talk to everyone," Cochran said. "If we think we might have good ways to help him [Dish Chairman Charlie Ergen] and work with him, then we will reach out to him." NPD: Smartphone shipments to cross 1B in 2016 Annual smartphone shipments around the globe are expected to nearly double by 2016 to reach more than 1 billion, according to a new report from NPD DisplaySearch, a unit of research firm NPD Group. According to the report, smartphone shipments will total 567 million in 2012, up from slightly fewer than 500 million in 2011. By 2016 that figure is expected to cross 1 billion, driven overwhelmingly by consumers upgrading to newer smartphones. NPD predicts that Apple's (NASDAQ:AAPL) iPhone 5, expected to be unveiled today, will help spur smartphone sales for the remainder of 2012. Despite that, NPD downgraded its 2012 forecast of new smartphones purchases from 220-230 million to 177 million. Over the next several years, replacement smartphone sales are expected to increase as the share of new smartphone sales declines, NPD said. "The timing of mobile phone contracts can also impact the smartphone market," Hiroshi Hayase, vice president of small/medium displays for NPD DisplaySearch, said in a statement. "More service providers are likely to shorten mobile phone replacement cycles in an effort to boost sales." The NPD forecast is slightly more bullish than some other recent ones on smartphone growth from analyst firms. In February Forrester Research predicted that in 2016 there will be a cumulative one billion consumers using smartphones. In August IHS iSuppli forecasted that by 2016 there will be 700 million mid-range to high-end smartphone users, with hundreds of millions more low-end smartphone users. AT&T looks to score CenturyTel's 700 MHz, AWS spectrum While AT&T Mobility (NYSE:T) awaits FCC approval of its purchase of 2.3 GHz WCS spectrum from NextWave Wireless and other companies, it is busy hunting for a variety of spectrum from CenturyTel. According to a recent FCC filing, AT&T is seeking agency approval for its purchase of 51 Lower 700 MHz Band B Block licenses, four Lower 700 MHz Band C Block licenses and six AWS licenses. AT&T said it wants the spectrum to boost capacity and spectral efficiency, especially for LTE services. The spectrum covers 54 Cellular Market Areas located in 14 states throughout the country. If the deals are approved, in 25 of the markets involved in the deal AT&T would hold a maximum of 55 MHz of spectrum below 1 GHz. Financial terms were not disclosed. Petitions to deny the deal are due Sept. 25; oppositions are due Oct. 5 and responses are due Oct. 15. The fresh deal comes as the FCC prepares to review its rules for how much spectrum a carrier should be able to hold. At its Sept. 28 meeting the FCC will vote on a notice of proposed rulemaking that will look at spectrum transfers between companies and will likely explore whether to treat lower-band spectrum differently than higher-band radio waves. The rules determine the FCC's so-called spectrum-screen, which it uses when reviewing spectrum transactions; if a carrier acquires too much spectrum and violates the screen, the deal is more closely scrutinized. Currently, the screen is different for each proposed transaction. In addition to its deals for the WCS spectrum, AT&T Mobility in recent months has sought approval for 700 MHz spectrum licenses from the likes of Cox Communications, Peoples Telephone Cooperative, 700 MHz L.L.C., and others. Further, AT&T may be a bidder for Verizon Wireless' (NYSE:VZ) 700 MHz Lower B Block spectrum. Verizon agreed to sell its Lower A and B Block spectrum if the FCC approved its $3.9 billion deal to buy nationwide AWS spectrum from a group of cable companies. The FCC approved that deal in August along with related spectrum deals with T-Mobile USA and Cricket provider Leap Wireless (NASDAQ:LEAP). CTIA mum after court throws out S.F. cell phone radiation ordinance A federal appeals court blocked San Francisco from enforcing an ordinance that would have required retailers to post signs and information warning customers of the potentially harmful effects of cell phone radiation. The court said that the city could not force retailers to distribute messages they disagree with. Meanwhile, the wireless industry's trade group stayed quiet in the wake of the ruling. The ordinance was supposed to go into effect in October 2011 but has been on hold due to court challenges from the CTIA.CTIA spokeswoman Amy Storey said the group did not have a comment. The original ordinance, believed to be the first of its kind in the nation, would have required retailers to give each customer buying a cell phone a fact sheet noting the World Health Organization had classified phones' radio-frequency emissions as a "possible carcinogen." Retailers would have also been required to post similar messages on large wall posters and on stickers attached to display ads. U.S. District Court Judge William Aslup ruled last fall that the ordinance went too far and ordered the city to change the fact sheet but said retailers could still be required to disclose undisputed facts about a "plausible public health threat." The wireless industry trade group said that even the narrowed ordinance still violates freedom of speech protections. However, in its ruling Monday the Ninth U.S. Circuit Court of Appeals in San Francisco blocked enforcement of the entire ordinance while the case continues. Now the city can ask the appeals court to review the case, it can go to the U.S. Supreme Court, or it can drop the issue. In August the Government Accountability Office urged the FCC to revise its 16-year-old cell phone radiation standards, adding another layer to the debate over the health effects of cell phone radiation. In a 46-page report, the GAO, which is the investigative arm of Congress, noted that the FCC's existing cell phone radiation limits are based on recommendations from federal and international health organizations that have since updated their standards based new research.
