1. Verizon to pay $510 million to settle ActiveVideo, TiVo patent suits

Verizon (NYSE: VZ) said Monday that it will pay more than $510 million to settle separate patent infringement disputes that it has been waging with interactive TV technology firm ActiveVideo Networks and TiVo Inc. (Nasdaq: TIVO).

The telco said it will pay ActiveVideo about $260 million that it was ordered to pay last year by a U.S. District Court for allegedly violating ActiveVideo patents related to video-on-demand and interactive TV technology. Verizon had worked with vendors Cisco (Nasdaq: CSCO) and Ericsson (Nasdaq: ERIC) in April to download new software to set-tops in FiOS TV subscriber homes that it said would not infringe on ActiveVideo patents.

In addition to the $260 million, Verizon and ActiveVideo agreed to cross-license their patents, and Verizon said it will pay ActiveVideo an additional amount of money that it did not specify. "In the end our technology and its value have been recognized," ActiveVideo President and CEO Jeff Miller said in a statement.

Verizon's settlement with TiVo comes just a few weeks before a trial involving its patent dispute was scheduled to begin. TiVo said Verizon will pay it at least $250.4 million to settle accusations that Verizon had violated patents related to its digital video recorder technology.  

Verizon and TiVo said they are also "exploring" distributing Internet video services that Verizon develops through its joint venture with Redbox through DVRs that TiVo sells in retail outlets. TiVo already offers viewers that buy its Premiere DVR access to online video content from Amazon (Nasdaq: AMZN), Netflix (Nasdaq: NFLX) and other providers.

The Verizon settlements are significant for both ActiveVideo and TiVo. ActiveVideo's largest customer is Cablevision (NYSE: CVC). Comcast (Nasdaq: CMCSA) is also testing its CloudTV platform on its cable system in Chattanooga, Tenn.

For TiVo's legal team, the Verizon deal marks their third large patent infringement settlement in less than a year. Last year, Dish Network (Nasdaq: DISH) agreed to pay TiVo $500 million to settle an infringement suit, and AT&T (NYSE: T) agreed to pay it at least $215 million to settle a dispute that accused the telco of violating TiVo patents with its U-verse TV service.

2. Google struggles to license regional sports channels for Google Fiber TV

Google (Nasdaq: GOOG) is having trouble reaching licensing deals with regional sports channels, such as Time Warner Cable's (NYSE: TWC) Metro Sports, for its Google Fiber TV deployment in Kansas City, attorneys for the Internet giant told FCC officials last week in a phone call.

While Google struck a carriage deal recently with Disney (NYSE: DIS) that will allow it to carry ESPN's family of networks in the Kansas City area, it lacks deals with Metro Sports, Fox Sports Net and Big Ten Network. Several other operators in the Kansas City area offer Metro Sports, which carries local high school sports programming, including Time Warner Cable, Comcast (Nasdaq: CMCSA), and cable overbuilder Knology, which was acquired recently by WideOpenWest for $1.5 billion.

AT&T (NYSE: T), which markets U-verse TV in the Kansas City area, also hasn't reached an agreement to carry Metro Sports.

Google plans to charge $120 monthly to subscribers in the Kansas City area for a package that will include pay TV channels and a wideband Internet connection that will offer speeds of 1 megabit per second. Some hardcore local sports fans may resist switching from Time Warner Cable or another provider to Google Fiber TV unless it is able to cut additional carriage deals for networks such as Fox Sports Net, Big Ten Network and Metro Sports.

3. Dish Network names P&G veteran Andrew Cipra VP of brand marketing

New Dish Network (Nasdaq: DISH) chief marketing officer James Moorhead recruited his former Procter & Gamble colleague Andrew Cipra, naming him VP of brand marketing.

Dish said Monday that Cipra will help its marketing team as the company looks to expand its product line to include broadband data and voice services. Cipra worked on ad campaigns for the Vicks brand at P&G, including spots for its NyQuil and DayQuil products. He worked earlier for 3M.

Dish, which has focused much of its marketing efforts this year on its new Hopper multiroom DVR, named Moorhead SVP and chief marketing officer in April. Moorhead had led marketing strategy for P&G's Gillette division, creating several humorous spots for its Old Spice brand.

Moorhead said Cipra will help the company improve its brand. "Andy has demonstrated a history of passionate, effective brand building, and I am confident that he has the vision and discipline needed to help establish Dish as a premier consumer brand," he said in a statement.

4. DirecTV apologizes to Sunday Ticket subscribers for missing Hail Mary touchdown

DirecTV (Nasdaq: DTV) apologized to subscribers of its $300 NFL Sunday Ticket package on Sunday after it missed a crucial play that resulted in the Detroit Lions - Tennessee Titans game being extended into overtime.

Soon after Lions backup quarterback Shaun Hill hurled a 46-yard Hail Mary pass in the final play of regulation, DirecTV cut to a commercial, resulting in Sunday Ticket subscribers missing receiver Titus Young catch the football and score a touchdown. The Lions, which scored two touchdowns in the final 18 seconds of regulation, ended up losing the game 44-41 in overtime after the Titans kicked a field goal.

DirecTV spokesman Robert Mercer said the company made an error by cutting away from the game early. "I don't have all the details, but it was our error. We sincerely apologize to you and all the viewers who missed the TD," Mercer told Michael David Smith, who writes a blog called ProFootballTalk on NBCSports.com.

Several Sunday Ticket subscribers complained about the missed play through posts on Twitter. DirecTV reduced the price on Sunday Ticket by more than $100 this year. It charges subscribers $300 for a "Sunday Ticket Max" version of the package that delivers games in high definition. It charges $200 for access to the standard-definition feeds of every football game on Sunday.

5. Frontier selects ETI's BSS/OSS software to support its FTTH network

Frontier Communications (Nasdaq: FTR) on Monday selected ETI Software Solutions as its Triad OSS/BSS platform to manage its FiOS Fiber to the Home (FTTH) networks in Oregon, Washington, South Carolina and Fort Wayne, Ind.

With the integration of the former Verizon lines complete, the service provider said it needed to convert the FiOS customers it gained in that acquisition onto its own Back Office Support/Operational Support Systems (BSS/OSS) systems.

The Triad now provides management of Frontier's key FTTH and video platforms: Motorola (AXS Vision), Alcatel-Lucent (NYSE: ALU) (GPON) and Motorola (DAC) and SeaChange (VOD) RF-based systems. An additional set of interfaces was created to support the Tellabs BPON FTTH platform and Juniper's (NYSE: JNPR) service router interface.

Jesse J. Ross, manager of Information Technology for Frontier Communications, said that by using the Triad system the service provider would be able to "simplify employee procedures, streamline processes and improve customer satisfaction."

To help ensure that it accurately bills its customers, ETI also implemented audit capabilities to both Alcatel and Motorola FTTH networks to identify mismatches between the billing data and the current provision state of the Optical Network Terminals (ONTs).

"This streamlines our internal processes, makes us more efficient, closes revenue leaks and ensures our customer statements are accurate and services uninterrupted," said Ross.

Managing FiOS has been a bit of a tough service call for the independent ILEC.

While it has continued to drive higher bandwidth speeds over its existing copper networks, it has been losing FiOS video and data subscribers every quarter following plans to dramatically increase the FiOS installation costs and monthly rates. In Q2 2012, Frontier reported that despite adding 13,300 satellite-TV customers via its relationship with Dish Network (NYSE: DISH), it lost 7,000 FiOS video customers.

SPOTLIGHT ON... FearNet selling dynamic VOD ads for Comcast subscribers

Horror network FearNet said it is beginning to sell dynamic video-on-demand ads. The network said Monday that it sold spots to 10 advertisers last month. Comcast is the first MSO to deliver dynamic VOD ads from FearNet to its subscribers, and Time Warner Cable is conducting ad-insertion tests, the network said. FearNet signed Sony Pictures Television to market its ad inventory to marketers. Canoe Ventures helped the network set up its dynamic VOD ad insertion platform, according to FearNet. Read more
