Apple must clarify its App Store policies once and for all

Apple (NASDAQ:AAPL) is a sphinx. Because the company so rarely divulges its motives and rationales, we can only guess at why it does the things it does. Just last week, for example, Apple quietly introduced new App Store age-rating notification boxes immediately below each iOS application's name and developer credit, a move that makes it easier for users to understand just what kind of experience awaits. Apple hasn't said why it rolled out the ratings boxes (of course), but the smart money says the move is a response to consumers and watchdog groups clamoring for greater transparency around the App Store shopping experience: Apple recently agreed to pay out more than $100 million to settle a class action lawsuit filed by parents whose children purchased virtual goods and enhancements sold inside iPhone and iPad apps without permission. Apple also came under fire following reports that photo and video sharing applications including Twitter's Vine and 500px contained sexually explicit content: Vine, 500px and other apps including Tumblr were ultimately updated to classifications of 17+, the App Store's highest age rating.

Applications that earn a 17+ tag may contain offensive language, violence, adult themes, sexual content, nudity, alcohol, tobacco and drugs. Apple routinely rejects apps that push those boundaries past their breaking point, however--and because it's never explicitly defined how far is too far, there's still a fair amount of guesswork involved. This week it appeared that writer Brian K. Vaughan and artist Fiona Staples' acclaimed space opera Saga crossed Apple's line of demarcation after news broke that digital comics applications like ComiXology would not be making the series' latest issue available to iPhones and iPads.

"As has hopefully been clear from the first page of our first issue, Saga is a series for the proverbial 'mature reader.' Unfortunately, because of two postage stamp-sized images of gay sex, Apple is banning Saga #12 from being sold through any iOS apps," Vaughan explained via fellow comics scribe Matt Fraction's Tumblr account. "This is a drag, especially because our book has featured what I would consider much more graphic imagery in the past, but there you go. Fiona and I could always edit the images in question, but everything we put into the book is there to advance our story, not (just) to shock or titillate, so we're not changing [anything]." Some critics even called Apple censors "homophobic," echoing Vaughan's comments that previous issues of Saga have featured far more extreme sexual situations, albeit involving heterosexual acts.

Here's the catch: Apple didn't actually ban Saga #12. ComiXology instead assumed the comic would never survive Apple's censorship gauntlet and buried it. An alleged Microsoft (NASDAQ:MSFT) product roadmap obtained by ZDNet indicates the company does not plan to expand its Office productivity suite to devices running Google's (NASDAQ:GOOG) Android and Apple's (NASDAQ:AAPL) iOS until the fall of 2014.

The roadmap outlining Microsoft's coming "Gemini" wave of Office updates states the firm will first focus on updating core products like Word, Excel, PowerPoint and OneNote, rolling out touch-capable versions optimized for the Windows 8 and Windows RT platforms this October. Gemini wave 1.5 will follow in April 2014, bringing revamped Office suites for Microsoft's Windows Phone mobile operating system and Apple's Mac desktop platform. Office for Android and iOS do not appear on the roadmap until late 2014, alongside Outlook for RT; ZDNet reports Microsoft is presently trialing Outlook for RT, suggesting the company could accelerate the product's timetable for release.

Microsoft declined to comment on the roadmap's authenticity. "We don't have any information to share about the next set of updates to Office," a spokesperson said.

Asked about Office for iPad at February's Goldman Sachs Technology and Internet Conference in San Francisco, Microsoft CFO Peter Klein said "We have a history of cross-platform delivery broadly in productivity, whether it's Office on the Mac, or e-mail, communications, note-taking. And with our Web applications you can access Office documents, do some light editing on any device and on any browser. So there's a lot of things that we're already doing to meet that need. And we'll continue to think about other things going forward."

Citing sources familiar with ongoing negotiations between the two companies, AllThingsD reported late last year that discussions to bring Office to iOS stalled over how Microsoft and Apple will share proceeds. Insiders say Microsoft is balking at giving Apple its standard 30 percent App Store cut of revenues from Office-branded, native iOS apps: Because Office is a perennial cash cow, it does not want to hand over such a large chunk of profits. Microsoft also contends that Office's value and utility will bring significant benefits to the iOS platform as a whole, meriting an adjustment to the 70/30 split. Apple has declined to comment on talks with Microsoft but has indicated it will not bend on App Store revenue sharing.

In a recent note to investors, Morgan Stanley analyst Adam Holt said Microsoft is leaving billions of dollars on the table by not porting Office to the iPad. Holt estimates that Microsoft sold fewer than 1 million Windows-based tablets in 2012 and will struggle to capture 10 percent of the tablet market this year; he also calculates that three to four times as many Mac users (between 30 and 40 percent) install paid versions of Office on their desktops as Windows PC users (10 to 15 percent) do. Assuming a similar 30 percent adoption rate across an installed base of more than 200 million iPads, Holt believes that Office for iPad priced at $60 would generate more than $2.5 billion in additional Microsoft revenues in 2014, even after Apple claims its App Store sales cut.

2. Mozilla CEO Kovacs to step down; Gong appointed SVP of mobile devices

Mozilla CEO Gary Kovacs said he will step down from his position later this year, a position he has held since 2010. The company said it has begun a search for a replacement CEO. Concurrent with the news, Mozilla announced a number of management movements including the appointment of Li Gong as Mozilla's senior vice president of mobile devices, where he will help oversee the progress of Mozilla's HTML5-based Firefox smartphone operating system.

Kovacs said he will continue to provide "vision and leadership" as a member of Mozilla's board of directors. Gong, currently president of Mozilla's Asia Operations, will work on advancing the adoption of Firefox OS on mobile devices, the company said, including engagement with Mozilla's device partners. Gong's appointment to the position makes sense considering most of Mozilla's Firefox phone makers are based in China and other Asian countries.

The news comes during a critical time for Mozilla. The company, best known for the Firefox desktop Internet browser, is working to expand its mobile strategy. A central part of that effort is Mozilla's Firefox OS, a smartphone operating system based around the HTML5 standard. The company earlier this year detailed its Firefox OS strategy, which revolves around selling low-cost Firefox phones into emerging markets. Mozilla earlier this year said the first Firefox OS devices will be available to consumers in Brazil, Colombia, Hungary, Mexico, Montenegro, Poland, Serbia, Spain and Venezuela, and that additional markets will be announced soon.  The company said a Firefox phone likely won't arrive in the United States until 2014.

Mozilla said 17 operators have so far committed to launching Firefox OS devices, including Sprint Nextel (NYSE:S), América Móvil, China Unicom, Deutsche Telekom, Etisalat, Hutchison Whampoa's Three Group, KDDI, KT, MegaFon, Qtel, SingTel, Smart, Telecom Italia, Telefónica, Telenor, TMN and VimpelCom. As for handsets, Mozilla said that TCL's Alcatel brand, LG Electronics and ZTE will build the first Firefox OS devices, with Huawei to follow later this year. More handset makers will likely be added in the future. All of the devices will run on Qualcomm's (NASDAQ:QCOM) Snapdragon processors.

"The past two and a half years have been pivotal in the evolution and rapid growth of Mozilla," said Kovacs. "I am very proud of our accomplishments as a team. In our mission to empower the next two billion Web users, we've made great advances in desktop and mobile and in our ability to lead at the pace of the market. With this solid foundation and a strong team in place, this is the right time for me to announce the transition plan and a vote of confidence in the abilities of the leadership team."

In a blog post announcing the news, Mozilla explained that Kovacs "accomplished the goals and objectives he and the team set out to achieve." The company said that Kovacs started in 2010 to help guide Mozilla's "pivot to mobile," and the company pointed to its Firefox smartphone OS and its Firefox browser for Android as evidence of the success of that pivot. Mozilla's now-shuttered Firefox browser for iOS was conspicuous in its absence from Mozilla's post.

More recently, Mozilla announced a partnership with Samsung Electronics to build Servo, an experimental Web browser optimized for mobile devices running Google's Android operating system and ARM processors.

"With a solid foundation now in place, Mozilla is entering an exciting phase--as we launch mobile devices with our partners around the globe--and a reinvigorated mission in protecting the Internet freedoms for the next 2 billion people coming online in the coming years," the company wrote.

3. Sprint rolls out Android Jelly Bean 4.1.2 to Samsung Galaxy Victory 4G LTE

Samsung Electronics' Galaxy Victory 4G LTE is the latest Sprint Nextel (NYSE:S) smartphone upgraded to Google's (NASDAQ:GOOG) Android 4.1.2 mobile operating system, a.k.a. Jelly Bean. The automatic download began rolling out to consumers this morning.

In addition to signature Android 4.1 features like the Project Butter UI engine, a revamped homescreen and Google Now, which includes personalized information such as local weather and traffic, the Sprint upgrade adds new capabilities including Swype mobile text input technology, conversational text-to-speech voice and offline voice typing. Notifications now display full text and photo messages, and users may also pinch notifications to expand or collapse them; in addition, notifications from the same application are now grouped together, and the first item is automatically expanded.

Galaxy Victory 4G LTE owners may also access an expanded Google Maps app bolstered by Zagat merchant reviews and ratings and indoor walking maps and manage/create Google+ Events directly from their device.

According to Google's Android Developers dashboard, Android Jelly Bean 4.1.x currently powers 23 percent of all devices worldwide, up from 14.9 percent a month ago. The spike follows Google revising its approach to measuring Android operating system version adoption, collecting data from each Android device that visits the Google Play digital storefront instead of tracking devices that check in on the company's servers.

4. Google Chrome beta for Android, iOS adds full-screen browsing

Google (NASDAQ:GOOG) released new versions of its Chrome browser beta for Android and Apple (NASDAQ:AAPL) iOS, highlighted by full-screen viewing options.

"We've heard your feedback, and now Web pages can display in full-screen on phones, which is especially handy on smaller screens," explained Google Chrome programmers Ted Choc and Eric Noyau. "As you scroll down a Web page and immerse yourself in the content, the top toolbar disappears. When you scroll up, the toolbar returns so you can get on to the next thing."

Chrome beta for Android now presents search terms in the omnibox address bar instead of the long search URL and the in-page Google search box. "This frees up room to view more search results and makes it easier to change your search terms, Choc and Noyau note. "You can also now see your data savings from the experimental data compression feature we introduced in our last Beta update. From this release onwards, go to 'Bandwidth Management' in Settings and enable 'Reduce Data Usage,' and you're all set."

Chrome for iPhone and iPad is also adding wireless printing, a feature rolled out to Android last year. Users can now print boarding passes, coupons or related documents directly from their iOS device via Google Cloud Print or Apple AirPrint; consumers may additionally save documents to Google Cloud Print.

Google introduced Chrome in 2008 and expanded the browser to Android and iOS last year. Chrome for mobile touts many of the same features as its desktop counterpart, and it enables users to port bookmarks and saved tabs from PCs to smartphones and tablets.

Earlier this month, Google launched Blink, an open-source rendering engine spinning out of WebKit, the engine powering Chrome as well as Apple's Safari browser. Google and Apple have collaborated on WebKit for years, each contributing to the same open-source codebase. With the decision to fork WebKit into Blink, that cooperation will end: Moving forward, Google and Apple will each work separately to introduce new browser features and enhancements.

5. Foursquare nabs $41M to fuel mobile advertising ambitions

Foursquare has secured $41 million in financing from private equity fund Silver Lake Partners and venture capital firms Andreessen Horowitz, Union Square Ventures, O'Reilly AlphaTech Ventures and Spark Capital.

Bloomberg Businessweek reports that a multiyear loan from Silver Lake makes up the bulk of the money--the remainder is convertible debt that can later be swapped for shares. By assuming debt instead of giving investors equity stakes, foursquare can delay discussions about its true market value--previous investment rounds valued the mobile social networking startup at $600 million, although a source familiar with foursquare's finances reveals the company raked in just $2 million in revenue in 2012.

Foursquare co-founder and CEO Dennis Crowley said the new financing will support the rollout of expanded mobile advertising services. In mid-2012, the startup introduced Promoted Updates, leveraging opt-in user location information to spotlight deals from nearby merchants. While more than a million retailers and restaurants have added their businesses to foursquare's database, the company had previously offered Promoted Updates inventory to only about 50 of them, mostly national chains like Walgreens and Starwood Hotels; beginning this summer, foursquare will open the program to all merchants and will build out its sales team to accommodate the move.

"This [financing] allows us to get closer to being able to prove that there's a real business here," Crowley said, noting that his slow, steady approach to monetizing the foursquare platform is vindicated by the struggles of rivals like Groupon, whose stock has declined 69 percent since its November 2011 IPO. "We've looked at the way other companies have grown very, very aggressively with products that seem to be working but are not the ones that end up changing the landscape," Crowley added.

Foursquare will sell advertisers on its service by promising a wealth of consumer insights: More than 40,000 third-party applications have integrated the foursquare platform instead of building out their own location databases, enabling the firm to collect data from popular social media apps including Facebook (NASDAQ:FB)-owned Instagram, Twitter's Vine and Path. Foursquare Chief Revenue Officer Steven Rosenblatt states that between 3 percent and 5 percent of users who receive a targeted advertisement after searching for a nearby restaurant or retailer click the ad or visit the merchant within 72 hours, far ahead of the average mobile click-through rate of less than 1 percent.

Crowley said foursquare also will strive to improve its search and discovery tools, which he admits were "buried" in previous iterations of the app. Earlier this week, foursquare revamped its Apple (NASDAQ:AAPL) iOS app: Version 6.0 shifts the Explore feature--which highlights nearby points of interest based on the user's check-in history and their friends' foursquare activity, complete with consumer reviews and merchant offers--from a separate tab at the bottom of the device screen to the top of the navigation bar. An overhauled auto-complete search engine delivers speedier local business and entertainment results than previous foursquare incarnations, and a retooled friends feed now includes recommendations, trending destinations and nearby contacts. Foursquare's signature check-in button also transitions to the bottom of the screen.

"We have about 12 million uniques for Crackle overall, and almost half of that is on connected devices, and that's a really big growth area for us."

Crackle also keeps Sony content in front of viewers who've abandoned traditional broadcasting services. "It's a little bit fluctuating, but we believe it's about 30 percent or one-third of the audience who do not have a pay service," Berger states. "A lot of people talk about cord cutting, and that's the metric that the people focus on, but we always talk about the cord nevers--that's the cohort to watch for this type of content."
