1. T-Mobile, Verizon take aim at AT&T as advertising wars heat up


A new ad from T-Mobile US (NYSE:TMUS) calls AT&T Mobility's (NYSE:T) new handset upgrade program "sneaky" and "underhanded." The ad is the latest attempt by T-Mobile to paint its larger rivals AT&T and Verizon Wireless (NYSE:VZ) as unfairly overcharging customers.

T-Mobile's ad, which is set to run today in USA Today, takes a quote from a recent article in The Verge that said, in part, "AT&T's reaction to T-Mobile's transparency is to be more deceptive than ever."

"We wouldn't call it deceptive, exactly," T-Mobile says in the ad. "Calculating, sneaky, underhanded, maybe, but not deceptive."

T-Mobile earlier this month announced its "Jump" handset upgrade program, and AT&T and Verizon announced their own handset upgrade programs just days later. A key distinction between the plans from Verizon and AT&T and T-Mobile's Jump plan is that Verizon and AT&T are not taking the cost of a device subsidy out of their rate plans; their rate plans remain the same under the upgrade programs, but customers who want to upgrade sooner are asked to pay the cost of the device as well. Although T-Mobile's Jump program has a $10 monthly fee, T-Mobile, through its Simple Choice plans, has effectively decoupled the cost of its service (which is cheaper than service from AT&T and Verizon) from the cost of devices.

"What we're doing is materially different than these so-called upgrade programs," T-Mobile CMO Mike Sievert told CNET. Sievert told AllThingsD that the carrier will run follow-up ads on Wednesday that also target Verizon. Verizon declined to comment, according to CNET, and AT&T spokesman Mark Siegel declined to comment to FierceWireless.

In a separate war of words, Verizon took out a full-page ad in the Wall Street Journal that hits back at AT&T's recent claim that its LTE network is the most reliable in the country. According to independent third-party data cited by AT&T--the source of which AT&T did not name--AT&T has "the highest success rate for delivering mobile content across nationwide 4G LTE networks." AT&T also cited recent studies from PCWorld/TechHive and PC Magazine as evidence that its LTE network is consistently faster than those of its competitors.

Verizon, which has built its reputation on its network reliability, didn't take kindly to AT&T's claim. Verizon says in its reaction ad that others have merely "tried to claim reliability."

"To us it's not a hollow claim," Verizon writes in the ad. "Or a slogan. Or a fancy ad campaign." AT&T declined to comment.

In its ad, Verizon touts the $7 billion it has spent to build out its LTE network and the testing it does to ensure the reliability of its network and devices.

The advertising war of words is indicative of both the rivalry between the nations' two largest carriers (this isn't the first time they've tussled over network reliability) as well as the importance of gaining customers in a market that is becoming increasingly saturated with each passing quarter.

2. Pentagon signals it would be willing to move off of 1755-1780 MHz band


The Department of Defense indicated it will be able to relocate its operations from the 1755-1780 MHz band, a move long sought by CTIA and wireless carriers, particularly T-Mobile US (NYSE:TMUS).

In a letter to the National Telecommunications and Information Administration filed with the FCC, the Pentagon said it can largely move off of the spectrum "while ensuring no loss of critical DoD capabilities."

The DoD was lambasted at a House hearing last month for not providing more information about the costs of using less spectrum, and the Pentagon's shift in potion is striking considering that it has long had concerns about moving its operations to give carriers more access to government-controlled airwaves.

Last week House members introduced legislation that would reallocate the 1755-1780 MHz band from government to commercial use and pair it with the 2155-2180 MHz band in an auction. Congress has already directed the FCC to allocate and license the 2155-2180 MHz band (known as AWS-3) by February 2015. The NTIA in March 2012 recommended that the 1755-1850 MHz band be repurposed for commercial wireless use on a shared basis. 

Further, wireless carriers have been open to the concept of sharing spectrum with federal users. For example, the FCC granted T-Mobile US' request last year to test the concept of sharing spectrum between federal and commercial users in the 1755-1780 MHz band.

However, it's unclear how workable the Pentagon's new offer of a compromise will be. The DoD said that it will cost about $3.5 billion to move its operations out of the spectrum. According to the Wall Street Journal, the Pentagon plans to compress much of its operations into the 1780-1850 MHz band, and will also move some of its operations to the 2025-2210 MHz band, which is currently used by TV broadcasters. However, the Pentagon left many details up in the air, including a timetable for moving off the 1755-1780 MHz band.

"T-Mobile is very pleased the Defense Department has proposed a path forward to make the 1755- 1780 MHz band available for commercial use, along with NTIA's proposal to consider these matters as part of the FCC's rulemaking process," Steve Sharkey, T-Mobile's director of government affairs for technology and engineering policy, said in a statement. "While there are many details that need to be resolved, this is a significant breakthrough toward meeting the goal of licensing this spectrum, paired with 2155-2180 MHz, by February 2015. We look forward to continued collaboration with DoD, NTIA, the FCC and others to finalize the implementation details, including consideration of the relocation spectrum identified."   

"I took it as a very positive step," Jot Carpenter, vice president for government affairs at the CTIA, told the Journal. "Getting them to put something in writing gives us now something to work from."

The NTIA said it would review the plan and was "very encouraged" by the move. 

Others, however, said the DoD proposal falls short since it's unclear how the Pentagon would share spectrum with broadcasters. "At first blush, the DoD proposal doesn't seem to make much sense," National Association of Broadcasters spokesman Dennis Wharton told the Journal. "While we are not opposed in principle to sharing where it works, DoD has done none of the legwork necessary to even begin the conversation."

3. Vodafone remains open to a Verizon offer for Verizon Wireless stake


Vodafone Chairman Gerard Kleisterlee said his company's board would seriously consider a proposal from Verizon Communications (NYSE:VZ) to buy Vodafone's 45 percent stake in Verizon Wireless if the deal gave Vodafone shareholders more value than they derive now from the partnership.

Kleisterlee said at the company's annual shareholder meeting that there was nothing new to announce about the companies' relationship. "If we see proposals that generate more value for shareholders we will consider them," he told investors, according to Reuters. "There is ongoing communication (that involves) the full board. Both executives and non-executives are involved in those negotiations with Verizon."

Rumors swirled earlier this spring that Verizon would consider a $100 billion bid for Vodafone's stake, which Vodafone has reportedly dismissed as inadequate. Verizon and Vodafone have not commented on the reports, but Verizon executives have made clear that the company is interested in acquiring Vodafone's stake. Verizon Wireless recently paid a $7 billion dividend to the parent companies.

Verizon Wireless has been a bright spot on Vodafone's balance sheet, which has been weakened by poor performances in its core European markets, especially in Southern Europe. Last week Verizon Wireless reported that total wireless revenue clocked in at $20 billion for the second quarter, up 7.5 percent year-over-year. The carrier also added 941,000 postpaid customers during the period.

"There is absolutely nothing that has changed (regarding a sale)" Vodafone CFO Andy Halford told reporters after the meeting. "The discussions we have (with Verizon) are about the business primarily, and the business continues to do very, very well."

4. LightSquared lenders rally behind plan by Dish's Ergen to buy company


A group of LightSquared's lenders filed a reorganization plan in bankruptcy court today that would largely follow the lines of Dish Network (NASDAQ: DISH) Chairman Charlie Ergen's $2.2 billion bid for control of LightSquared's spectrum holdings.

According to Dow Jones Newswires, the Ergen-led group said the bid would pay in full the company's $1.7 billion in bank debt. LightSquared last week lost control of its own bankruptcy reorganization plan and said that it expected multiple proposals to reorganize the company.

The lender group, which owns debt in the LightSquared LP unit that controls the company's spectrum, includes Capital Research & Management, Cyrus Capital Partners, Intermarket Corp., UBS, Stamford Branch and SP Special Opportunities, which is owned by Ergen. Ergen's L-Band Acquisition LLC already made a $2 billion cash offer for LightSquared's assets earlier this year.

The new proposal is only for LightSquared LP's assets, which includes 46 MHz of L-Band MSS spectrum. LightSquared Inc., which is 96-percnet-owned by Phil Falcone and his Harbinger Capital Partners hedge fund, is not part of the deal; LightSquared Inc. indirectly owns the equity of LightSquared LP.

LightSquared has not been able to get creditors to support a reorganization timeline and has offered a streamlined process, which Bloomberg reported is scheduled to be evaluated today in U.S. Bankruptcy Court in Manhattan. LightSquared wants to have outlines of all competing reorganization plans filed by Sept. 4, with a Dec. 16 confirmation hearing to approve the best one.

LightSquared is one of the many wireless options that Dish's Ergen has pursued. Dish recently dropped its bids to purchase Sprint (NYSE:S) and Clearwire. Analysts have said Dish may now try to partner with T-Mobile US (NYSE:TMUS).

LightSquared launched in 2010 with a plan to build an LTE network that could offer wholesale capacity to other providers. However, the company ran into concerns that its network would interfere with GPS receivers, a situation that pushed the FCC to reject LightSquared's network buildout plans. As a result, LightSquared filed for bankruptcy last year.

Now, in order to address the interference concerns, LightSquared is hoping to share spectrum that is currently set aside for weather balloons used by the federal government. In exchange, LightSquared said it would permanently relinquish its 10 MHz of spectrum that is directly adjacent to the frequencies used by GPS receivers.

"Now LightSquared has set out a lengthy timetable for an auction in December 2013 (which is already subject to an objection from the Secured Lenders), because (in fantasyland) Harbinger is apparently highly confident that the FCC will approve LightSquared's request in November, enabling them to raise money for a counterbid on the back of that approval, before the auction actually takes place," TMF Associates analyst Tim Farrar wrote in a blog post. "However, even if LightSquared's proposed timetable is approved (and it appears that the judge is actually losing patience with the company's repeated delays), it seems rather more likely that Falcone is instead going to be 0 for 3 in his battles with Ergen (with LightSquared following the path trodden by DBSD and TerreStar)."

5. Verizon launches Motorola's Droid Mini, Ultra and Maxx, with hints of Moto X


As expected, Verizon Wireless (NYSE:VZ) today during a press event unveiled the latest incarnations in its Droid series of Android smartphones from Google's (NASDAQ:GOOG) Motorola Mobility unit. Although the focus of event was on the Droid franchise, the announcement did give some hints as to what kind of features might be available in Motorola's forthcoming Moto X smartphone.

Verizon released a trio of new Droids from Motorola.

Verizon said it will launch the Motorola Droid Mini for $99, the Droid Ultra for $199 and the Droid Maxx for $299, all with a two-year contract. The carrier said customers can pre-order the devices now at droiddoes.com and the phones will be available Aug. 20. If customers purchase one of the new phones by the end of September they will get six months of free Google Music All Access service.

"If we look back to 2009 to the day we launched the first Droid, every time we've launched a new Droid device we've set a new sales mark," Jeff Deitel, Verizon's vice president of marketing, said at the company's media event in New York City, according to The Verge. "Today we're here to talk about a refresh of the Droid franchise."

Verizon emphasized that the Mini is a more compact version of the Ultra, and the Maxx is centered around improved battery life. Rick Osterloh, Verizon's senior vice president of products, said the carrier's old Droid Razr Maxx HD was 9.3 mm thick and had 32 hours of battery life, while the new Maxx is 8.5 mm thick and can and run for 48 hours.

The new phones use a Motorola-designed chipset called the "Motorola X8 Mobile Computing System," a new 8-core chip. The chip has two application processor cores, four graphics cores, a contextual computing core and another core for "natural language processing."

All of the phones also use what Osterloh termed "touchiness control," which lets users make phone calls, ask for directions or search through voice. Among the other software features on the phones: "Active display" brings up important notifications on the devices' screen when they are sleeping, and "quick capture" allows users to quickly launch the camera function.

Some of those features may make their way into the Moto X, a phone that Google has started an advertising campaign for. A recent demonstration video reportedly released by Canadian operator Rogers Wireless indicates the Moto X smartphone will integrate an always-on voice command feature enabling users to access services and information without touching the handset.

First spotted by Ausdroid, the video depicts a user speaking the words "OK Google Now" to retrieve the local weather forecast. "Your Moto X is ready to listen and respond," the video states. "Talk to it and it learns your voice. With the power of Google Now, it tells you what you need to know even when you're not touching the screen."

Although Google hasn't released any specifics about the Moto X, the company has said users will be able to customize the device to their liking due to the fact it will be assembled in the United States.

Localytics, InMobi and others firms are trumpeting the importance of "customer lifetime value," which many others dub "lifetime value of a customer" (LTV), to app developers.
