Tough Choices Two Years In
At the start of my term as New TLD Applicant Group (NTAG) Chair, I wrote about the importance of the 50th ICANN meeting for applicants. The meeting is significant, not only as a milestone for ICANN, but also because it marks two years since ICANN began processing new gTLD applications. Two years in, the program is at an inflection point. The final initial evaluation result was published two weeks ago and the first ICANN auction will take place this week. more »

Second House Amendment Ups the Stakes on IANA Transition
The House of Representatives has passed another measure related to the proposed IANA functions transition, and has again attached it to "must pass" legislation. This move ups the ante and may well be the final straw that compels the Senate Commerce Committee to hold its own oversight hearing on the IANA transition proposal.On May 30th the House adopted the Duffy Amendment to the Appropriations bill funding the Commerce, Justice, and State Departments in FY 2015. The final vote on the amendment was 229 in favor and 178 opposed -- it was fairly partisan outcome, with only ten Democrats voting aye while just one Republican voted nay. more »

Alternatives for .COM ? (Part 1)
There are plenty of new domain names and if .COM never had any real identity or true meaning, it is quite possible that new gTLDs may bring new ideas to those who want to acquire a global identity without focusing on a country, a niche market, a specific industry, a community or just anything which does not cover "the world". Disclosing Unique User IDs in URLs Doesn't Violate ECPA - In re Zynga/Facebook
In separate lawsuits, plaintiffs alleged Facebook and Zynga violated the Stored Communications Act (in Zynga's case, also the Wiretap Act). The crux of plaintiffs' allegations was that when a Facebook user clicked on an ad or a link, the HTTP request sent by the browser included the user's Facebook ID and the address of the webpage the user was viewing when he or she clicked the link. An end user's request to play Farmville would result in the transmission of similar information to third parties. more »

FCC's "Commercial Reasonableness" Standard Already a Dismal Failure
T-Mobile filed a petition today making it clear that the FCC's commercial reasonableness standard is a failure. Anyone following net neutrality knows that the FCC is proposing to authorize discrimination and pay-for-priority deals known as fast lanes. The FCC is claiming we need not worry, however, because the FCC can make sure that entrepreneurs and users face only "commercially reasonable" discrimination. more »

Why Do We Accept $10 Security on $1,000,000 Data?
Last week we heard of yet another egregious security breach at an online provider, as crooks made off with the names, address, and birth dates of eBay users, along with encrypted passwords. They suggest you change your password, which is likely a good idea, and you better also change every other place you used the same password. But that's not much help since you can't change your name, address, and birth date, which are ever so handy for phishing and identity theft. more »

DOTCOM Act Passes House as Rubio Leads Senate Call for IANA Oversight Hearings
The Shimkus Amendment to the $601 billion National Defense Authorization Act (HR 4435) passed the House of Representatives on May 22nd by a mostly partisan vote of 245–177. While all 228 Republicans present and voting supported the amendment only 17 Democrats voted "aye", with 177 in opposition. Final passage on the entire bill was a bipartisan vote of 325–98. The Senate has not yet passed its version of a FY 2015 Pentagon funding bill, and once it does all the differences between the two versions must be reconciled before it can be sent to President Obama for his signature. more »
