| One type of racial disparity occurs when there is a significant difference between the percentage of a racial group represented in the general population and the percentage of the same group represented at any point in the justice process For example AfricanAmericans make up percent of the US population but account for about percent of all arrests percent of the prison population and percent of the inmates on row Another type of racial disparity appears whenever there is a significantly larger percentage of members of a racialminority group involved in a part of the criminal justice system than whites For instance more than percent of all AfricanAmerican adult males are in jail or prison or on probation or parole compared with not quite percent of all white adult males To cite another example blacks are four times as likely as whites to be arrested on charges�even though the two groups use s at almost the same rate The reasons racial disparities exist Racial disparities in criminal justice are explained in three ways differential involvement individual and institutional First AfricanAmericans and Hispanics aredifferentially involvedin criminality�they commit more crimes Their criminality is tied to the fact that these groups suffer from poverty and unemployment Second some of the disparities are due to the bigotry of individual police officers prosecutors defense attorneys judges probation officers parole officers and parole board members Thisindividual consists of prejudicial beliefs and discriminatory behavior of individual criminal justice authorities against blacks and other minority group members Third part of the disparities can be attributed toinstitutional This type of occurs whenever there are statutes classifications and practices that have a disparate unequal impact on racial minorities Is the Criminal Justice System Racist American society is becoming more racially and economically polarized Many poor and minority citizens subscribe to thediscrimination thesisDT that the criminal justice system is racist A recent Gallup poll showed that nearly twothirds of the AfricanAmericans surveyed believe that the criminal justice system is rigged against them Many civil rights advocacy groups agree but many conservatives deny that the system is racist The criminal justice system is not racist Criminologist William Wilbanks who wroteThe Myth of a Racist Criminal Justice System is the leading apologist for racial disparities in the American justice system Wilbanks and others who maintain the system is color blind advance the follog arguments Most decisions in criminal justice arenotbased on discrimination Research demonstrates that decisions throughout the justice systems are based mainly on the seriousness of the crime the amount of legal evidence proving guilt that is available and the prior criminal record of the suspect defendant or inmate There is nosystematic in criminal justice Wilbanks coined the phrase systematic and uses it as an ideal standard against which to measure American criminal justice In disproving the discrimination thesis he wraps the complex question of racial discrimination into two bundles labeled The Criminal Justice System Is Racist and The Criminal Justice System Is Not Racist He says either there is discrimination inallparts of the criminal justice system for example in the police courts and corrections and inallstages of the criminal justice process or there isnoracial discrimination in the system After revieg the scholarly literature Wilbanks concludes that the criminal justice system is not racist because the evidence fails to prove that is present in all parts of the system during all steps of the criminal justice process The criminal justice system is racist | ||||
