Register Today! | Can the FCC get the balance right with its spectrum rules? The FCC on Thursday will decide rules for next year's incentive auction of 600 MHz broadcast TV spectrum. It will also decide rules for how much spectrum wireless carriers can hold in different markets--the FCC's so-called spectrum screen. The event will be the most consequential meeting of FCC Chairman Tom Wheeler's term so far, and it will have a fundamental impact on the direction of the U.S. wireless industry. Right now, it looks like Wheeler is trying to placate different factions within the industry, but he could wind up with most carriers being peeved at the final results. First, let's look at the incentive auction rules. For the better part of a year, Verizon Wireless (NYSE: VZ) AT&T (NYSE: T) and their surrogates in academia have argued that if the FCC places restrictions on how much spectrum they can bid on in the auction, it will cause broadcasters not to give up their spectrum, depress auction revenues and basically lead to a failed auction. Sprint (NYSE: S), T-Mobile US (NYSE:TMUS) and their allies in academia and the public interest community have argued that they will not be able to effectively compete in the long term without rules that level the playing field and allow smaller carriers a shot at getting low-band 600 MHz airwaves. It seems like the FCC's draft rules for the auction favor Sprint and T-Mobile, and that the auction may not turn out to be the disaster that Verizon and AT&T predict. Under the proposed rules, the FCC would withhold, or reserve, up to 30 MHz of spectrum for auction bidders that hold less than one-third of the available low-band spectrum in that market. The amount of reserved spectrum would vary on a market-by-market basis based on demand, but wouldn't exceed 30 MHz. All bidders could bid on the unreserved spectrum in the market, but the reserved spectrum is intended for smaller carriers that don't have lots of low-band spectrum. Critically, the FCC would withhold spectrum only after a still-to-be-determined threshold has been met, which could be whether the FCC has already raised enough money to pay broadcasters off for the spectrum they will be giving up. AT&T looking to buy all of Sprint's 2.3 GHz WCS spectrum licenses, possibly for in-flight Wi-Fi AT&T Mobility (NYSE: T) has inked an agreement to purchase all of Sprint's (NYSE: S) WCS spectrum licenses. Sprint owns 19 2.3 GHz WCS licenses in locations across the South including in markets in Florida, Louisiana, Texas, Alabama, Georgia and elsewhere. The companies did not disclose the financial details of the transaction, which still requires FCC approval. Representatives from both AT&T and Sprint declined to comment beyond the companies' FCC filing on the transaction. This is the latest bunch of WSC licenses AT&T has purchased. In 2012, the carrier paid $600 million for a broad swath of WCS licenses from NextWave Wireless, a transaction that BTIG analyst Walter Piecyk tweeted equates to around $0.40 per MHz per POP. AT&T has also purchased WCS licenses from Comcast, Horizon Wi-Com and San Diego Gas & Electric Company. It's unclear exactly what AT&T will do with the licenses. However, AT&T last month said it will use LTE technology and some of its spectrum to offer in-flight Wi-Fi services starting in late 2015, an action that will directly challenge current in-flight connectivity players like Gogo, Row 44, Inmarsat and others. BTIG's Piecyk noted at the time that AT&T said it is considering using its WCS spectrum for the in-flight service, but hasn't decided on that yet. AT&T would need FCC and FAA approval for an in-flight connection service. AT&T could also use its growing portfolio of WCS spectrum to bolster the capacity of its LTE network, which currently runs across its 700 MHz and AWS spectrum holdings. In its filing with the FCC on the transaction, AT&T noted only that it would use Sprint's WCS spectrum for "mobile broadband use, thereby supporting [the Commission's] goal of expanding mobile broadband deployment throughout the country." AT&T also noted that, if the transaction is approved, it would hold up to 165 MHz of spectrum in some of the markets covered in the deal, thus putting it over the FCC's so-called spectrum screen. The FCC's spectrum screen is designed to limit the total amount of spectrum any one company can own in a specific market. AT&T said it would exceed the FCC's initial spectrum screen in 31 of the 713 total counties covered by Sprint's 19 licenses, though AT&T argued that there is still spectrum available for its rivals in those markets and that it should not be prevented from acquiring the WCS licenses. That AT&T mentioned the FCC's spectrum screen is notable considering the agency is currently evaluating changes to its screen in an effort to prevent larger carriers from purchasing overwhelming amounts of spectrum. AT&T's purchase of the WCS licenses underscores AT&T's strategy of purchasing spectrum on the secondary market, rather than directly through FCC auctions. AT&T has purchased AWS, WCS and 700 MHz licenses from a wide range of smaller companies in recent years. The carrier is also considering participating in the FCC's upcoming auctions of AWS-3 and 600 MHz spectrum. As for Sprint, it comes as little surprise that the company is offloading its WCS licenses. Sprint has focused its LTE network buildout on its 800 MHz, 1900 MHz and 2.5 GHz spectrum holdings. Report: Verizon could challenge Sprint Spark with AWS-powered 'XLTE' branding Verizon Wireless (NYSE: VZ) will soon start marketing its LTE network running on its AWS spectrum as an "XLTE" network, according to the blog Droid-Life. The blog, citing unnamed sources, said Verizon would start using the marketing term on May 19. A Verizon spokesman declined to comment. It's unclear what exactly might change besides the new moniker. Verizon has been deploying AWS spectrum to augment capacity on its LTE network since last fall. Verizon's macro LTE network, which covers around 305 million POPs, is based on the carrier's 700 MHz Upper C Block spectrum. Speaking earlier this month at an investor conference, Verizon Communications CFO Fran Shammo said the company has "started to launch our AWS spectrum especially in our major cities and we will roll that across the United States over the next 14 to 18 months." Verizon had previously said it would launch AWS spectrum in 50 different cities in the first half of 2014. Verizon acquired a 20x20 MHz block of AWS airwaves covering 54 percent of the U.S. population from a group of cable companies in 2012 for $3.9 billion. Nicola Palmer, Verizon Wireless' chief network officer, has said that, in every major city east of the Mississippi and in several western markets, Verizon's AWS spectrum would essentially allow the carrier to double the amount of spectrum it can use for LTE, from 20 MHz to 40 MHz. The push to deploy AWS makes sense as Verizon said that 73 percent of all its data traffic now travels over its LTE network. More than a quarter of the LTE smartphones on the carrier's network can now access AWS spectrum, and virtually all of Verizon's new smartphones are AWS-capable. As part of Verizon's marketing for its "More Everything" shared data plans, the carrier has said that its network now has "double the bandwidth in cities coast to coast." Other carriers are also augmenting the capacity and performance of their LTE networks. T-Mobile US (NYSE:TMUS) is starting to deploy 4x2 MIMO antenna technology in its LTE network to enhance network performance at the cell edge and generally boost the customer experience. Sprint (NYSE: S) has branded its tri-band LTE service as Spark; the service takes advantage of Sprint's 2.5 GHz spectrum and radios that have capabilities for 8 Transmitters 8 Receivers (8T8R), which the carrier has said will improve network performance. And AT&T Mobility (NYSE: T) is starting to refarm its 1900 MHz PCS spectrum for LTE services in major market as well. Sony aims to sell 50M smartphones this year after falling short of 40M goal last year Sony said its Sony Mobile Communications unit hopes to sell 50 million smartphones in its coming fiscal year after falling short of last year's goal of 40 million, which itself had been revised down. The company aims to meet the higher smartphone sales target for its new fiscal year, which runs until March 2015. In reporting its earnings for the last fiscal year and quarter, Sony said it sold 39 million smartphones last year, up from 33 million the year before. In February, Sony lowered its smartphone sales target for the fiscal year to 40 million units from its previous forecast of 42 million units. At the time, Sony said smartphone sales in China and other Asian countries as well as in Europe were weaker than the company had expected. For the full fiscal year, sales in Sony's mobile phone and VAIO PC unit increased 29.6 percent year-over-year. Sony said the mobile phone segment of the business actually turned a profit for the year but the overall unit was dragged down by declining PC sales and an operating loss in that part of the business. Sony has said it will focus on markets outside of the U.S. and China to boost smartphone sales, even though China and the U.S. are the two largest smartphone markets in the world. The company does not have a U.S. carrier partner for its flagship Z2 smartphone, but has said it will sell the phone in the U.S. unlocked sometime this summer. Sony CFO Kenichiro Yoshida told investors on an earnings briefing call that the firm would aim to reduce volatility in its electronics business by promoting smartphone contracts with enterprise clients, according to Reuters. Overall, Sony said it expects its sixth annual loss in seven years in this coming fiscal year because of lingering effects of the restructuring of its consumer electronics business. For the 12 months ending March 2015, Sony is estimating it will post a net loss of around $490 million, narrower than the $1.25 billion loss the company reported for the last fiscal year but much weaker than the profit analysts had expected. Isis activated at least 600,000 mobile wallets in the past month Mobile wallet and payment venture Isis said that on average it has activated more than 20,000 mobile wallets per day in the past 30 days, giving it at least 600,000 members during that period. The venture, backed by Verizon Wireless (NYSE: VZ), AT&T Mobility (NYSE:T) and T-Mobile US (NYSE:TMUS), has been slowly dribbling out data on how it is performing in the marketplace since it launched on a nationwide basis last November. In a blog post, Isis CEO Michael Abbott wrote that the company's wallet activation growth rate doubled over the prior month. The company declined to say how many total wallets it has activated since launching its NFC-based payment service. As of today, 68 mobile devices from Verizon, AT&T and T-Mobile support the Isis Wallet, which now comes preloaded on 14 smartphones, with more preloaded devices in the pipeline. "So what's next?" Abbott wrote. "We plan to further broaden our ecosystem of partners to provide customers with more options as well as new ways to save. We'll continue to offer compelling consumer deals--all with the goal of helping consumers become ever more comfortable with mobile wallets. Along those lines, we'll continue to innovate to ensure Wallet users have a simple and enjoyable experience while paying with Isis." An Isis spokeswoman told FierceWireless that Isis is currently accepted at "hundreds of thousands" of merchant locations nationwide and at any merchant that supports contactless payments, such as McDonald's, Jamba Juice and Coca Cola vending machines. Isis declined to say how much money wallet users spend through Isis per month "since Isis is just the platform facilitating transactions." In March, the company said that two-thirds of its users have installed at least one payment card into their Isis wallet, and that group of users makes an average of six to seven NFC-based financial transactions per month. Isis' service relies on a "secure element" inside a smartphone that stores users' credit card information. Isis users can make payments with participating retailers and banks (Wells Fargo, Chase, American Express and others through American Express' Serve technology) by tapping their phone on a payment terminal. The mobile payments market is not easy sledding for any player though, no matter how established. Earlier this week Square said it would shut down its Square Wallet app for Android and iOS. Square launched its Wallet app three years ago. It allowed customers to use payment info stored on their phones to pay for goods by checking into a restaurant and letting cashiers know who they were at checkout. However, that app seems to have foundered and Square is introducing a replacement called Square Order, which will let customers make pick-up orders from, and pay at, coffee shops, cafes and other Square merchants from their smartphones. Google (NASDAQ: GOOG) Wallet chief Ariel Bardin said in April that customers have been slow to embrace the company's mobile payments service. However, he said that Google plans to remain in the mobile payments space for the long haul, and will continue to tweak the technology in hopes it will take off. Apple (NASDAQ: AAPL) CEO Tim Cook recently said he thinks the mobile payments market hasn't been "figured out" yet. "I think it's a really interesting area," Cook told the Wall Street Journal in late April of mobile payments. "We have almost 800 million iTunes accounts and the majority of those have credit cards behind them. We already have people using Touch ID to buy things across our store, so it's an area of interest to us. And it's an area where nobody has figured it out yet. I realize that there are some companies playing in it, but you still have a wallet in your back pocket and I do, too, which probably means it hasn't been figured out just yet." FCC gets an earful from all sides as it considers reclassifying broadband As FCC chairman Thomas Wheeler mulls changes to net neutrality rules, representatives from all corners of the industry--from cable and telecom executives to Hollywood and Capitol Hill players--are giving him their two cents on the issue. The FCC will release proposed new rules regulating the Internet on Thursday, and no one appears happy with what's been floated so far. The new rules are being crafted in the wake of a federal appeals court ruling in January that struck down the existing basis for the FCC's net neutrality guidelines. Wheeler's new proposed rules seek to prevent broadband providers from blocking or slowing down websites but would allow some content companies to pay for preferential treatment. He has also indicated he'll look at turning broadband service into a Title II service, which would treat the delivery mechanism as a common carrier or utility. More than two dozen cable and telecom industry titans are begging the commission not to reclassify broadband as a Title II service, arguing that "the growth of the Internet and the rapid adoption of mobile technology have been great American success stories, made possible by a light regulatory touch for the entire online ecosystem." They went to say that imposing "common carrier-style regulation upon any part of the Internet would be a dangerous rejection of this successful policy course, potentially impeding the development and adoption of new Internet technologies and services, and threatening future investment in next-generation broadband infrastructure." At the same time, Hollywood bigwigs are asking the FCC to make sure the Internet remains "free and open." In an open letter signed by 240 Hollywood showrunners and creators, the group wrote that "if Net Neutrality is neutered, the Internet will become like cable television. A few corporate gatekeepers such as Comcast will be allowed to decide what content consumers can access and on what terms. The danger is that blocking, discrimination and paid prioritization could occur." "That is exactly what has occurred in our traditional film and television business," the content creators wrote. "After decades of consolidation and mergers, seven corporations control 95% of television production and viewing." And not to be left out, ranking U.S. Senate and House members urged Wheeler to seek Congressional aid. In a letter signed by Mitch McConnell (R-Ky.), John Cornyn (R-Tex.), John Thune (R-S.D.) and others, the lawmakers urged Wheeler to ditch the net neutrality rules he's proposing and work with Congress to develop new statutes rather than "attempting further legal contortions to encumber modern communications networks with last century's rules." The lawmakers agreed with the ISPs' notion that a light regulatory touch has "freed Internet innovators and users at the edge, the core, and the last mile to offer services, to build networks, and to buy and sell products based on market demand; no government permission has been necessary."
